Welcome to Blue Endurance. These Terms of Service ("Terms") govern your access to and use of the Blue Endurance website, mobile applications, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

1. Acceptance of Terms

By creating an account, accessing, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Services

Blue Endurance provides personalized endurance training coaching services powered by artificial intelligence. Our Services include:

Personalized training plans and workout recommendations
Integration with fitness devices and platforms (such as Garmin)
Activity analysis and performance tracking
Fitness metrics, forecasting, and individualized guidance
Mobile applications for accessing your training information

The Services are designed to provide general fitness guidance and are not a substitute for professional medical advice, diagnosis, or treatment. Always consult with a qualified healthcare provider before beginning any exercise program.

3. Account Registration

To access certain features of the Services, you must create an account. When creating an account, you agree to:

Provide accurate, current, and complete information
Maintain and promptly update your account information
Maintain the security of your account credentials
Accept responsibility for all activities that occur under your account
Notify us immediately of any unauthorized use of your account

You must be at least 13 years of age to use the Services. If you are under 18, you represent that you have your parent or guardian's permission to use the Services.

4. Subscriptions and Payment

a. Subscription Plans

Access to certain features of the Services requires a paid subscription. Subscription plans and pricing are described on our website and may be updated from time to time.

b. Billing

By subscribing to the Services, you authorize us to charge your designated payment method on a recurring basis according to your chosen billing cycle (monthly, quarterly, or annually). Subscriptions automatically renew unless cancelled before the renewal date.

c. Refunds

We offer a 14-day money-back guarantee for new subscriptions. If you are not satisfied with the Services, you may request a full refund within 14 days of your initial purchase. Refund requests should be sent to support@blueendurance.com.

d. Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, you will continue to have access to the Services until the end of your current billing period. No refunds will be provided for partial billing periods after the 14-day guarantee period.

5. Acceptable Use

You agree not to use the Services to:

Violate any applicable laws or regulations
Infringe upon the rights of others
Transmit any harmful, offensive, or objectionable content
Attempt to gain unauthorized access to the Services or related systems
Interfere with or disrupt the Services or servers
Use automated means to access the Services without our permission
Reverse engineer or attempt to extract the source code of the Services
Use the Services for any commercial purpose without our consent

6. Third-Party Integrations

The Services may integrate with third-party platforms and devices, such as Garmin Connect. Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of third-party services. You authorize us to access and retrieve your data from connected third-party services in accordance with our Privacy Policy.

7. Intellectual Property

The Services and all content, features, and functionality (including but not limited to software, algorithms, text, graphics, logos, and images) are owned by Blue Endurance or its licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial use.

You retain ownership of any data you submit to the Services. By submitting data, you grant us a license to use, process, and analyze that data to provide and improve the Services.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

THE TRAINING RECOMMENDATIONS AND GUIDANCE PROVIDED BY THE SERVICES ARE FOR INFORMATIONAL PURPOSES ONLY AND SHOULD NOT BE CONSIDERED MEDICAL ADVICE. YOU ASSUME ALL RISKS ASSOCIATED WITH YOUR USE OF THE SERVICES AND ANY EXERCISE OR TRAINING ACTIVITIES YOU UNDERTAKE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUE ENDURANCE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNTS PAID BY YOU TO BLUE ENDURANCE DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Blue Endurance and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of another.

11. Modifications to Services and Terms

We reserve the right to modify, suspend, or discontinue the Services (or any part thereof) at any time, with or without notice. We may also modify these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website or through other communications. Your continued use of the Services after such modifications constitutes your acceptance of the updated Terms.

12. Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.

14. General Provisions

Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Blue Endurance regarding the Services.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Waiver. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
